Communities and Prejudice in Mediation Self-Determination

Professor Carrie J. Menkel-Meadow
Georgetown University Law Center

This paper will discuss (and critique) the focus on the future in much mediation. While mediation gives us the possibility of an enriched future of reconciliation, it must also deal with experience of past wrongs, hurt and responsibility in order to be a process that can really promise justice. The issue of whether peace and justice can mutually co-exist continues to plague debates about mediation as a process compared to other processes like adjudication.
